Terms of Service

TheLastClicks provides professional photography, videography, and post-production editing services (collectively, the "Services"). The specific scope, deliverables, timelines, and pricing for each project will be outlined in a separate written agreement, quotation, or booking confirmation provided to you before work begins.

We reserve the right to modify our service offerings, pricing, and packages at any time without prior notice for future bookings.

Booking Confirmation: A booking is confirmed only upon receipt of a signed agreement (or written confirmation via email) and payment of the required deposit/advance, as specified in your quotation.

Payment Terms: Payment terms will be outlined in your booking confirmation. Unless otherwise agreed, a non-refundable deposit of 30% is required at the time of booking, with the remaining balance due before or on the date of the session/event.

Late Payments: Overdue invoices may be subject to a late fee of 2% per month on the outstanding balance. Deliverables may be withheld until full payment is received.

Accepted Methods: We accept payments via bank transfer, UPI, and other methods as communicated at the time of booking.

Client Cancellation: If you cancel a confirmed booking, the following terms apply:

• More than 14 days before the event: Full refund of the deposit minus a 10% administrative fee.

• 7–14 days before the event: 50% of the deposit is refundable.

• Less than 7 days before the event: The deposit is non-refundable.

Rescheduling: You may reschedule your booking once without penalty, subject to availability, provided the request is made at least 7 days before the original date.

Cancellation by TheLastClicks: In the unlikely event that we need to cancel due to unforeseen circumstances (illness, equipment failure, force majeure), we will offer a full refund or reschedule at no additional cost.

Ownership: All photographs, videos, and edited content produced by TheLastClicks remain the intellectual property of TheLastClicks unless explicitly transferred in writing.

Client Licence: Upon full payment, you are granted a non-exclusive, non-transferable licence to use the delivered content for personal, non-commercial purposes unless a commercial licence is separately agreed upon.

Portfolio Rights: We retain the right to use images and videos from your project in our portfolio, website, social media, and marketing materials unless you expressly opt out in writing before the session.

No Unauthorised Editing: You agree not to alter, crop, or edit the delivered content in a way that misrepresents the original work without our prior written consent.

Delivery: Estimated delivery timelines will be communicated at the time of booking. Standard delivery for photography is 2–4 weeks and for videography/editing is 4–8 weeks after the session or event.

Revisions: Each package includes a specified number of revision rounds. Additional revisions beyond the included rounds will be billed at our standard hourly rate.

File Formats: Final deliverables will be provided in digital format (JPEG, PNG, MP4, or as agreed). Raw files are not included unless specified in your package.

Storage: We retain project files for up to 12 months post-delivery. After this period, files may be permanently deleted. Please ensure you back up your files promptly.

• Provide accurate project details, locations, timelines, and necessary permissions in a timely manner.

• Ensure access to venues and locations as agreed, including any required permits.

• Designate a point of contact for communication during events.

• Inform us of any specific requirements, restrictions, or sensitivities before the session.

• Provide timely feedback during the revision process to avoid delays.

TheLastClicks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to loss of data, loss of profits, or damage to equipment.

Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question.

We are not responsible for unforeseen events beyond our control, including but not limited to weather conditions, venue issues, power outages, or acts of God.

Neither party shall be liable for failure to perform obligations under these terms if prevented by circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, civil unrest, or technological failures. In such cases, both parties will work together in good faith to reschedule or find a mutually acceptable solution.

Accuracy: While we strive to ensure all information on our website is accurate, we do not guarantee that all content is complete or error-free.

Prohibited Use: You agree not to use our website for any unlawful purpose, to interfere with its operation, or to attempt to gain unauthorised access to our systems.

Third-Party Links: Our website may contain links to external sites. We are not responsible for their content or privacy practices.

Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the matter shall be subject to the jurisdiction of the courts in Noida, Uttar Pradesh, India.

These Terms of Service are governed by the laws of India.

We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the updated terms.
